Terms of service

1. The Service

DuckClick lets an AI agent operate an Android phone from your browser, lets you take over at any time, and lets you save successful runs as Flows that can be replayed or scheduled. We may add, change or remove features. Free and paid plans, and early access, can have different limits, described on the pricing page.

2. Accounts and eligibility

You must be at least 18, or the age of majority where you live. Give accurate information, keep your credentials secure, and tell us if you suspect unauthorized use. You are responsible for everything that happens under your account.

3. Your phones, accounts and instructions

• Use DuckClick only with phones and accounts that you own or are authorized to operate.
• You are responsible for the instructions you give the agent and for what it does on your behalf, including messages sent, purchases made and data changed. Review approvals before you grant them.
• Apps have their own terms, and some forbid automation. You are responsible for complying with them. We are not responsible if an app limits or closes an account.
• AI can make mistakes. Check important results yourself, and do not use the Service where an error could cause injury or serious loss, such as emergencies, medical decisions or safety systems.

4. Acceptable use

You agree not to:

• break the law, or infringe other people's rights;
• commit fraud, send spam or bulk unsolicited messages, or create fake engagement, reviews or accounts;
• harass, threaten or harm others, or produce unlawful content, including child sexual abuse material;
• get around security controls, lock screens, captchas, payment protections or rate limits, or access a device without authorization;
• upload malware, interfere with the Service, or probe it for vulnerabilities without our written permission;
• reverse engineer, resell or sublicense the Service except as the law allows or we agree in writing.

5. Third-party models and apps

The Service works with AI models and gateways that you choose and with apps on your phone. These are third-party services under their own terms. We do not control them and are not responsible for their availability, output or charges. If you enter your own API key, the provider bills you directly.

6. Plans, billing and renewal

• Paid plans are billed in advance for each billing period (monthly, unless the plan says otherwise) by our third-party payment processor.
• The Lifetime plan is a single payment and does not renew. It gives access to the paid features for as long as we offer DuckClick; if we stop offering it, we will give reasonable notice.
• The Monthly plan renews automatically until you cancel. You can cancel at any time; cancellation takes effect at the end of the current period and you keep access until then.
• Prices are shown on the pricing page and exclude taxes unless stated. We will give notice before a price change applies to you.
• If a payment fails we may retry it and, if it still fails, suspend paid features.
• Refunds follow our Refund Policy.

7. Your content

You keep ownership of the content you send through the Service. You give us a limited licence to host, process and display it only as needed to provide the Service to you. You promise you have the rights to the content you use. How we handle personal information is described in our Privacy Policy.

8. Our property

The Service, the DuckClick name and logo, and everything we provide belong to us or our licensors. We give you a limited, revocable, non-transferable licence to use the Service under these terms. If you send us feedback, we may use it without obligation to you.

9. Availability and changes

We work to keep the Service running but do not promise it will be uninterrupted or error-free. We may change or discontinue parts of the Service, and will give reasonable notice of changes that significantly harm paying customers.

10. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or end your access if you breach these terms, put the Service or others at risk, or fail to pay, and we will give notice where practical. After termination, sections that by their nature should continue (including 7, 8, 11, 12 and 13) stay in effect.

11. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or US$100 if you paid nothing. Nothing in these terms excludes liability that cannot be excluded by law, and mandatory consumer rights remain unaffected.

13. Indemnity and governing law

You will compensate us for claims and costs arising from your misuse of the Service, your instructions to the agent, or your breach of these terms or of a third party's terms. These terms are governed by the law of the place where DuckClick's operator is established, without regard to conflict-of-law rules, and courts there have jurisdiction, without removing any mandatory consumer protection that applies to you.

14. Changes to these terms

We may update these terms. We will post the new version here with a new date and tell you about material changes. If you keep using the Service after they take effect, you accept them.
